WNYLC NY Health Access Website Posts Step-by-Step Guide to Enrolling in a NYSARC Pooled SNT

The Evelyn Frank Legal Resources Program of Selfhelp Community Services, Inc. has posted a step-by-step guide to enrolling in a NYSARC Pooled SNT for Medicaid spend-down purposes on the NY Health Access website:

“This article is intended as a condensed road-map for using the NYSARC Pooled SNT to eliminate the Medicaid spend-down.  This article contemplates that the individual is applying for Medicaid in order to obtain home care services.  The sequence of events will be different if that is not the case.”

As the author points out:

“There are many other Pooled SNTs in New York, but this one has the most favorable fee structure for monthly contributions of excess income.”

    Regarding the monthly spend down for Medicaid.  Mybrother is in subsidized housing, paying a very
    affordable rent due in part to his Medicaid spend down for home health care and out of pocket expenses; without this expense of the spend down, when he recertifies for HUD his rent will go up appreciatably.  The
    reason is:  the amount of his spend down will now go into the NYYSARC trust and be available to him for
    personal expenses such as rent.  Has anyone faced this issue during the decision process of whether to join the trust?
